  • TERMS OF USAGE

    • Body Mantra enforces a strict 6-hour cancellation policy. If you reserve a place in a class and fail to cancel 6 hours in advance, you will be considered a 'Late Cancel' and charged $20, as well as receive 1 class credit. If you fail to cancel and do not show up to a reserved class, you will be considered a 'No-Show' and charged $25, as well as receive 1 class credit.

    • Instructors and classes are subject to change without notice.

    • Clients are limited to one class per day on any and all memberships. 

    • For sanitary and safety purposes, grip socks are required during the workout and are available for purchase at the studio. 

    • All clients agree to Body Mantra, LLC Terms & Conditions and terms of usage prior to attending class.

    • Classes are non-refundable and non-transferable. Multi-class packages cannot be shared. No exceptions!

    • Monthly Auto/Pay Memberships may be put on hold for minimum of 14 days and maximum of 60 days

    • Classes and prices subject to change

    LIABILITY WAIVER

    • DISCLAIMER OF LIABILITY: Body Mantra urges all clients to obtain a physical examination from their physicians prior to initiating any exercise program. Body Mantra studio training programs are not designed for individuals with known heart disease with or without functional impairment. In recognition of the possible dangers connected with any physical activity, client(s) hereby knowingly and voluntarily waive(s) any cause of action of any kind whatsoever arising as the result of such activity from which any liability may or could accrue to Body Mantra, its officers, agents, employees, instructors or assigns and agree to hold Body Mantra harmless therefrom.

      1. SEVERABILITY:  If any part of this contract shall be held invalid, that part shall be deemed excluded from this contract and the remainder of the contract shall remain in full force and effect.

      2.NOTICE: ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED PURSUANT HERETO OR WITH THE PROCEEDS HEREOF. RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER.

      3. JURISDICTION: To the full extent permissible by law, for purposes of any dispute arising out of this agreement, all parties hereto agree to submit to the sole and exclusive jurisdiction of the State of Florida and to the application of Florida law. Any action hereunder shall be brought in Sarasota County, Florida. A condition precedent to any suit or action arising from any dispute between the parties shall be mediation pursuant to Florida Statute.

      4. ENTIRE AGREEMENT: The Client and Body Mantra acknowledge that this Agreement constitutes their entire agreement. It cannot be amended except in written form executed by both parties. 

      5.BUYER’S RIGHTS: 

      a. The membership and this contract are not negotiable, transferable, or cancel-able except as otherwise provided herein. You, the buyer, may cancel the agreement penalty-free within 3 days, exclusive of holidays and weekends, of its making, upon the mailing or delivery of written notice to the health studio, and refund upon such notice of all moneys paid under the contract, except that the health studio may retain an amount computed by dividing the number of complete days in the contract term or, if appropriate, the number of occasions health studio services are to be rendered into the total contract price and multiplying the result by the number of complete days that have passed since the making of the contract or, if appropriate, by the number of occasions that health studio services have been rendered. A refund shall be issued within 30 days after receipt of the notice of cancellation made within the 3-day provision.  

      b(i). The client may cancel this contract and receive a refund of the contract if the contracting business location of the health studio (4942 S Tamiami Trail, Unit 200, Sarasota, Florida 34231) goes out of business, or moves its facilities more than 5 driving miles from 4942 S Tamiami Trail, Unit 200, Sarasota, Florida 34231 and fails to provide, within 30 days, a facility of equal quality located within 5 driving miles of 4942 S Tamiami Trail, Unit 200, Sarasota, Florida 34231 at no additional cost to the buyer.

      (ii) Any notice of intent to cancel by the buyer shall be given in writing to Body Mantra using the cancellation request form available at the studio with 30 days’ notice to Body Mantra. Client may cancel at any time and for any reason after the initial contract period using the cancellation form. Such a notice of cancellation from the consumer shall also terminate automatically the consumer’s obligation to any entity to whom Body Mantra has subrogated or assigned the consumer’s contract. If Body Mantra wishes to enforce such contract after receipt of such notice, it may request the Florida Department of Agriculture and Consumer Services to determine the sufficiency of the notice.

      (iii) If the Florida Department of Agriculture and Consumer Services determines that a refund is due to the buyer, the refund shall be an amount computed by dividing the total contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term. The business location of a health studio shall be deemed out of business when temporarily closed for repair and renovation of the premises:   

               1. Upon Sale, for not more than 14 days
               2. During ownership, for not more than 7 consecutive days and not more than 2 periods of 7 consecutive days in any calendar year.

      A refund shall be issued within 30 days after receipt of the notice of cancellation made pursuant to this paragraph.

      c. The client should contact the Florida Department of Agriculture and Consumer Services for information within 60 days if Body Mantra goes out of business.

      d. Death or Disability: The client may cancel the contract if the buyer dies or becomes physically unable to avail himself or herself of a substantial portion of those services which he or she used from the commencement of the contract until the time of disability, with refund of funds paid or accepted in payment of the contract in an amount computed by dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term. Body Mantra may require a buyer or the buyer’s estate seeking relief under this paragraph to provide proof of disability or death. A physical disability sufficient to warrant cancellation of the contract by the buyer is established if the buyer furnishes to the health studio a certification of such disability by a physician licensed under chapter 458, chapter 459, chapter 460, or chapter 461 to the extent the diagnosis or treatment of the disability is within the physician’s scope of practice. A refund shall be issued within 30 days after receipt of the notice of cancellation made pursuant to this paragraph.

      e. The initial contract will not be for a period in excess of 36 months, and thereafter shall only be renewable annually. A renewal contract may not be executed and the fee therefor paid until 60 days or less before the previous contract expires.

      f. If Body Mantra requires a buyer to furnish identification upon entry to the facility and as a condition of using the services of the health studio, the health studio shall provide the buyer with the means of such identification.

  •  INFORMATION WE COLLECT AND HOW WE USE IT

    Personal Information

    We collect Personal Information when voluntarily submitted by you, either on our Website, through download of the App, use of the Exercise Service, or through information provided in-studio, at events, or in connection with other Mantra Fitness interactions. We use this Personal Information to ensure a successful experience at a Mantra Fitness studio as applicable, and to adhere to the Membership Terms and Conditions you agree to when completing a purchase on our website. To use certain features of the Mantra Fitness Internet Services, we require you to create an Account by providing your name, phone number, email, a password, and when necessary, credit card information.

    We also collect your Personal Information for security and monitoring purposes. When you sign-in and participate in a class, we collect and store your performance data on the Mantra Fitness Internet Services. We may combine information that you provide in-studio, at events, or in connection with other Mantra Fitness interactions with information stored on Mantra Fitness Internet Services, and we may combine information with data that is publicly available and data from third parties. We also collect information about gift recipients provided by the giver. You can choose not to provide us with certain information, but this may limit the features of the Mantra Fitness Internet Services that you are able to use.

    While you are using our Website or App, including the Exercise Service, we may use cookies and tracking technology (“Cookies”) to collect both Personal and Anonymous Information. Cookies are useful for gathering Anonymous Information such as tracking the number of visitors to the Mantra Fitness Website and understanding how visitors use the Website. Cookies can also be used to automatically collect your IP address and other device specific information. We will use this information to analyze your use of the Mantra Fitness Internet Services, and also to provide you with specific marketing and promotional offers via email, text, push notifications, and/or direct mail. Aggregate, anonymized cookie and tracking information may be shared with third parties. If you decide at any time that you no longer wish to accept Cookies from the Mantra Fitness Internet Services for any of the purposes described above, then you can instruct your browser, by changing its settings, to stop accepting Cookies or to prompt you before accepting a Cookie from the websites or apps you visit. If you do not accept Cookies, however, you may not be able to use all of the Mantra Fitness Internet Services or access certain features of the Mantra Fitness Internet Services. Information about how you may communicate with Mantra Fitness to opt out of receiving email, text, or direct mail communications or how to disable or modify Cookies is below.

    As you use the App, we may collect location-based information from you through your mobile or other location-aware device. Certain features of the Mantra Fitness Website and App are location-specific and can provide helpful information and allow you to access additional Mantra Fitness Internet Services based on where you are. If you tell us where you are (i.e., by allowing your mobile device to send us your location), we may use that information to provide you with location-based information, allow you to check-in for classes or other services, and/or market to you based upon this location-based information. If you want to, you may disable location services on your mobile device, but we will not be able to provide those features. Please contact your carrier for more information.

    We may create interfaces that allow you to connect with a social networking service (“SNS”), such as Facebook, through the Mantra Fitness Internet Services. When authorized by you and after you have provided the relevant log-in information, the SNS provides us a token that allows the SNS to recognize us when we ask, on your behalf, for access to your Account information. For example, when you click “Connect” to grant us access to your Facebook account, we will import your name and other information from Facebook and, as you use the Mantra Fitness Internet Services, we may periodically check for updates to such information. You can revoke our access to any SNS at any time by amending the appropriate settings from within your Account settings on the applicable SNS.

    We will not collect Personal Information indiscriminately but will limit collection of Personal Information to that which is reasonable and necessary and is authorized by law.

    We will use your Personal Information to administer your Account, process and fulfill transactions initiated by you (both online and in-studio), provide you with customer support, tailor the features and content of the Mantra Fitness Internet Services and other Mantra Fitness related content to you, and market our products and offers. We will also use your Personal Information to send updates, notices, announcements and additional information related to our product offerings. Finally, we will use your Personal Information to protect us and you from fraud or error, comply with legal and regulatory compliance, and verify your compliance with your obligations in our Terms of Service and Terms and Conditions.

It will notify you of the following: What personally identifiable information is collected from you through the website, how it is used and with whom it may be shared. What choices are available to you regarding the use of your data. The security procedures in place to protect the misuse of your information. How you can correct any inaccuracies in the information.

    We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone. We may use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. to ship an order. Unless you ask us not to, we may contact you via email or phone in the future to tell you about specials, new products or services, or changes to this privacy policy.

    You may opt out of any future contacts from us at any time. You can do the following at any time by contacting us via the email address or phone number given on our website: See what data we have about you, if any. Change/correct any data we have about you. Have us delete any data we have about you. Express any concern you have about our use of your data.
    Security. We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.
    Whenever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for “https” at the beginning of the address of the Web page.
